Two relatives are languishing in police custody for two counts of unlawful entry, and trespass.
Accused persons: Tijuani Annan Darpoh 54 and Ibrahim Nii Annan Darpoh, 50 have been remanded by the Ashaiman Circuit Court for unlawful entry; contrary to section 152 of the criminal offences Act 1960(Act 29) on count one.
For count two, the duo were charged for trespass: contrary to section 157 of the criminal offences Act,1960(Act 29).
The court presided over by His Honour, Mr. Simon Nketiah Gaga said due to the severity of punishment upon conviction, the duo cannot be granted bail.
Therefore A1 and A2 were remanded into police custody as prosecution was ordered to file witness statement before the next adjourned date of May 22,2024 for mention.
Prosecution: presenting the D/C/Inspector Philip Parimah I/C case, the prosecuting officer ASP Fuseini Sugri told the court that complainant Jackline Minka aged 34 who is a business woman resident of Community 25 while A1, Tijuani Annan Darpoh 54 and Ibrahim Nii Annan Darpoh 50 is an electronic technician both of whom are siblings and residents of Prampram.
The complainant is a caretaker of a parcel of land of dimensions 100 by 240 feet situated at Community 25, Tema belonging to one Jacob Lamptey who leaves abroad.
The complainant reported to Tema Regional Command on 3/5/2024 that the padlock of a gated land had been broken by unknown person(s), accessed thereon and were developing the said land.
The prosecuting officer told the court that police accompanied the complainant to the scene and met the accused persons together with two others constructing a building profile.
They were subsequently arrested to the Tema Regional CID. Investigations revealed that in 2007, one Nene Kwaku Darpoh, the then head of the Darpoh family of Prampram, witnessed by some elders of the family, granted the said piece of land to David Lamptey of blessed memory who registered the land with a land title certificate from land commission in 2010 to maintain his ownership.
He then went into possession by building a gated fenced wall around it and secured with a lock.
It was further detected that the late David Lamptey willed the property to his son, Jacob Lamptey.
However, on the 3/5/2024, the accused persons unlawfully entered the land and started development.
In the accused persons’ cautioned statements, they claimed that as per one of the agreements between the grantors and grantee was to develop the land within three years(3 years), without which the family shall re-enter the land hence their actions.
After investigations, the accused persons were charged with the offences as stated on the charge sheet and brought before this honourable court.
